Terms of service

Last updated: 13 October 2026

These terms apply to bespoke digital work (browser-based web apps and tools, hosted on Vercel) supplied by Damian Gozzett, trading as DGDigital, a sole trader based in Brighton & Hove, England (“we”, “us”). “You” means the client. Contact: hello@dgdigital.dev.

1. Quotes

We give a written quote setting out the work (the “scope”), price and estimated timescale. Quotes are valid for 30 days. A contract is formed when you accept the quote in writing (email is fine) and, where asked, pay the deposit.

2. Deposits and payment

  • For jobs over £150, unless the quote says otherwise, a 50% deposit is due before work starts and the balance is due on delivery. Jobs of £150 or less are invoiced in full on delivery. Mock-ups are free and watermarked.
  • Invoices are payable within 14 days.
  • For business clients, late payments may carry statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
  • Prices are shown as stated on the quote. We will tell you clearly if VAT applies.

3. Scope and changes

We deliver what the agreed scope describes. If you want changes or extra features, we will confirm the effect on price and timing in writing before doing them. Small clarifications within the spirit of the scope are included.

4. Delivery

Timescales are estimates made in good faith. We will keep you updated and tell you promptly about any delay. Delivery happens when we hand over the working tool, files or access described in the scope.

5. Your responsibilities

  • Give us accurate information, sample data, access and timely feedback.
  • Make sure you have the right to share any data, content or systems you give us, and that your use of the finished work complies with the law (including data protection law).
  • Keep your own backups of your data and systems.
  • Delays caused by missing information or feedback may move the timescale.

6. Intellectual property

Once you have paid in full, ownership of the bespoke work we create for you transfers to you. Until then, you have a licence to use it for testing only. We keep ownership of our general tools, know-how and reusable code, and you receive a permanent, non-exclusive licence to use any of it that is included in your work. Third-party and open-source components stay under their own licences. We may describe the project in general terms in our portfolio unless you ask us not to.

7. Warranty: 30-day bug fixes

For 30 days after delivery we will fix, free of charge, any bug where the work does not do what the agreed scope describes. This does not cover new features, changes you or others make, misuse, or changes to third-party services, platforms or data formats after delivery. Ongoing support can be agreed separately.

8. Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. For business clients: we are not liable for loss of profit, revenue, data or business, or for indirect or consequential loss, and our total liability under each contract is limited to the price paid for that work. For consumers: we are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill, but not for loss that was not foreseeable; we do not supply work to consumers for business use.

9. Cancellation and refunds

  • Business clients: you may cancel at any time by email. The deposit is non-refundable once work has started, and you pay for work done up to cancellation. If cancelled before work starts, we refund the deposit.
  • Consumers: under the Consumer Contracts Regulations 2013 you have 14 days from the day the contract is formed to cancel without giving a reason. If you ask us to start work within those 14 days and then cancel, you must pay for the work done up to the time you tell us. To cancel, email hello@dgdigital.dev with a clear statement; we refund any money due within 14 days.
  • Digital content: if we supply digital content (for example a downloadable tool or report) and you agree that it may be supplied within the 14-day period and acknowledge that you then lose the right to cancel, the right to cancel ends once supply begins.
  • We may end the contract if you materially break these terms (for example by not paying), after giving you notice and a reasonable chance to fix it.

10. Confidentiality and data

We keep your business information confidential and use your data only to deliver the work. Where we process personal data on your behalf, we do so on your instructions and can sign a data processing agreement. See our privacy notice.

11. General

These terms, together with the quote, are the whole agreement. If any part is found unenforceable, the rest still applies. Neither party is responsible for delays caused by events outside its reasonable control.

12. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
